Summary

Advertising of discount sales in accordance with the law and in an informative manner ensures the protection of consumers, the prevention of unfair competition and the good functioning of the competition market. For this reason, discount sale advertisements are regulated to prevent unfair competition under the Turkish Commercial Code and to protect consumers under consumer legislation. The Regulation on Commercial Advertising stipulates that discount sale advertisements must specify “the price before the discount, the start and end dates of the discounted sale, and if the quantity of the goods or services offered for sale at a discount is limited, this quantity” and cannot contain misleading statements. In advertisements for goods or services offered for sale through a loyalty program, expressions that create the impression of discounted sales cannot be used. Advertisements that do not comply with these conditions will be inspected by the Advertising Board and administrative sanctions will be imposed. If the discount sale advertisement is deceptive or misleading, it constitutes unfair competition and sanctions for unfair competition are applied. In this study, discount sale advertisements are analyzed in terms of unfair competition and consumer protection in line with the legal regulations and the decisions of the Advertising Board and the Supreme Court.
